Following the approval of the reform of the judicial framework of the Court of Justice of the European Union on 16 December 2015, the regulation on the transfer to the General Court of jurisdiction at first instance in disputes between the European Union and its servants, adopted on 6 July 2016, was published in the Official Journal of the European Union on 26 July 2016. It applies from 1 September 2016.
The regulation provides for jurisdiction over European civil service cases — which, until then, was conferred on the European Union Civil Service Tribunal (CST) — to be transferred to the General Court from 1 September 2016. The Court of Justice has jurisdiction as an appeal court in such cases with effect from that date.
In order to ensure the efficient conduct of proceedings in the civil service cases pending on the date of transfer, provision has been made for transitional arrangements. The General Court has also adopted various internal measures, and its rules of procedure have been amended to take account of the transfer of jurisdiction.
Finally, the transfer is proceeding in conjunction with the incorporation into the General Court of the seven judge’s posts of the CST, which will cease to operate on 1 September.
The last stage of the reform will follow in 2019 with the addition of nine further Judges to the General Court, which will then consist of two Judges per Member State.
