Germany is planning a new law against onlookers of accidents. Photographing and filming of accident victims could be banned.

Onlookers can cause a dangerous situation, against which the Lower Saxony Interior Minister Boris Pistorius (SPD) wants to proceed. He has brought a proposal for a new law: photographing and filming of accident victims should be banned. Such behavior is considered “dangerous and disrespectful to the victims”

After a car had crashed into an ice cream parlor in Bremervörde two people had died - and there were tangible conflicts between the onlookers and the policemen. There have been many such situations in the past months.

Onlookers increasingly post videos and photos of the accidents on the Internet. Since in recent years many people have obtained smartphones capable of taking pictures and movies, this trend has intensified.

This behavior is dangerous, because onlookers hinder the rescue operations of the police, firemen, emergency physicians, where often time is a matter of life and death.

According to the Interior Minister of Saxony Nadine Bunzler, such behavior when criminalized, can be limited by the police.

So far, those recordings are not against the law. Only the publishing or distribution of the material is prohibited, if the person portrayed have not agreed. In the proposed bill, the regulation should be tightened. The photographing or filming of accident victims, regardless of a publication, violates the dignity of human beings and therefore needs to be punishable according to the Interior Ministry.
